1) Agreement to Terms

HomeHealthCare101 (homehealthcare101.com) is a brand owned and operated by N ZEE LLC.

These Terms & Conditions ("Terms") govern your use of websites, landing pages, forms, SMS/MMS and email communications operated by N ZEE LLC ("N Zee," "we," "us," or "our"). By submitting a form, texting in, opting in, or using our services, you agree to these Terms and our Privacy Policy.

Company & Contact:

2) Eligibility

You must be 18+ to use our services or provide consent. By engaging, you represent you are the account holder (or authorized user) of the phone number and email you provide.

3) SMS/MMS & Email Program; Consent & E-Sign

By providing your phone number/email and clicking submit, texting a keyword, or otherwise giving written consent, you authorize N Zee to send recurring marketing and informational communications via automated technology (including autodialers, prerecorded/AI-assisted messages, and email automation).

Consent is not a condition of purchase.

SMS opt-in data and consent are not shared, sold, or disclosed to third parties or affiliates for marketing purposes.

E-Sign Disclosure: You agree to receive required disclosures, consents, and confirmations electronically.

4) Message Frequency, Costs, and Carriers

Frequency varies (typically 1–8 msgs/month), including occasional bursts around events or reminders.

Msg & data rates may apply.

Delivery is subject to your carrier's network. Carriers are not liable for delayed/undelivered messages.

5) Opt-Out & Help

Text STOP to end SMS. Recognized opt-out words: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT.

You may also email haroonkamal@me.com or call +1 (610) 604-6700 to opt out of SMS or email.

For help, reply HELP or contact us via email/phone above.

After opting out, you may still receive non-marketing messages required to service your requests or account (e.g., legal notices).

6) Opt-In Records & Changes

We maintain records of consent (time/date, source, IP/UA when applicable). You agree to inform us promptly of any changes to your contact information. Recycling/Reassignment: If your phone number or email changes or is reassigned, you must re-opt in.

7) Acceptable Use

You will not: (a) attempt to interfere with or abuse our platforms, (b) submit unlawful, defamatory, deceptive, or infringing content, (c) use bots or scraping tools without permission, (d) impersonate another person, or (e) submit third-party contact data without proper consent.

8) Intellectual Property

All content, branding, training materials, and software are owned/licensed by N Zee and protected by IP laws. You receive a limited, revocable, non-transferable license to access materials for personal, lawful use only.

9) Informational Purpose; No Medical/Legal/Financial Advice

This training is for educational and informational purposes only and does not constitute medical, legal, or financial advice. Nothing provided should be interpreted as guidance for patient care or as a substitute for consultation with licensed healthcare professionals, attorneys, or financial advisors. Always comply with applicable local laws and regulations when establishing and operating a healthcare agency.

10) Disclaimers

SERVICES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES (EXPRESS/IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT RESULTS, UPTIME, OR ERROR-FREE OPERATION.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, N ZEE AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, ENHANCED, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/DATA. OUR AGGREGATE LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

12) Indemnification

You agree to indemnify, defend, and hold harmless N Zee and its affiliates from claims arising out of your (a) use of the services, (b) breach of these Terms, (c) violation of law or third-party rights, or (d) submission of data without proper authorization/consent.

13) Third-Party Services

We may use third-party vendors (e.g., CRM, SMS/email gateways, analytics, payment processors). Their services are governed by their terms/policies. We are not responsible for third-party acts or omissions. Our marketing and communication services may be managed by a third-party agency on our behalf.

14) Modifications

We may modify these Terms or the program at any time. Changes become effective upon posting an updated date or providing notice. Continued use after changes constitutes acceptance.

15) Governing Law; Venue; Arbitration; Class Waiver

Governing Law: Pennsylvania law, without regard to conflicts principles.

Venue: State/federal courts in Montgomery County, Pennsylvania for any matter not subject to arbitration.

Arbitration: Any dispute arising out of or relating to these Terms or our services shall be resolved by binding arbitration administered by the AAA under its Commercial Rules.

Class Action Waiver: Claims must be brought individually; no class/representative actions or class arbitration.

Injunctive Relief: Either party may seek temporary injunctive relief in court to protect IP/confidential information.

16) Children's Privacy

You must be 18 years of age or older to use our services, including our SMS program. We do not knowingly collect personal information from individuals under 18. If we learn we have collected information from someone under 18, we will delete it promptly.

17) Severability; Assignment; Entire Agreement

If a provision is unenforceable, the remainder remains in effect. We may assign these Terms; you may not without our consent. These Terms plus the Privacy Policy are the entire agreement regarding the program.
